USCG Prohibition against Unauthorized entry into Cuban Waters

The U.S. Coast Guard promulgated a requirement that U.S. vessels and vessels without nationality, less than 100 meters in length, located within U.S. internal waters or the 12-nautical mile territorial sea, that thereafter enter Cuban territorial waters, apply for a receive a permit from the Coast Guard. This rule replaces the earlier requirement that vessels have Coast Guard authorization prior to entering Cuban waters. The new rule became effective on July 2, 2004. 69 Fed. Reg. 41367 (July 8, 2004). This rule was issued pursuant to an Order of the Secretary of Homeland Security. 69 Fed. Reg. 41365 (HK Law).
